AirHelp, a flight compensation company for passenger rights, found that in 2017 more than one million passengers traveling from the U.S. to Europe may be entitled to more $555 million in airline compensation due to missed connecting flights.
If flights are booked together under one reference code, passengers can claim $300 to $700 in compensation from the airlines if they miss a connecting flight due to an earlier disruption under EC 261 or Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004. It’s a European law that requires airlines to compensate passengers for lengthy flight delays, cancellations, and in situations where they are denied boarding. Passengers on E.U. flights that are eligible under EC 261 must be paid up to $700 in compensation for flight delays of more than three hours. If you fly inside the E.U. or from Europe to elsewhere, you’re entitled to compensation for a cancellation or a delay of more than three hours regardless of airline. If you fly to the E.U., you must be on an E.U. airline.
While many travelers don't know how to determine whether they are eligible for compensation, or how to file claims, with AirHelp's new tool, you can check for eligibility through the AirHelp website or app.
If you have a multi-flight trip, it's possible that only a portion of it will be factored into your compensation. To determine this, your journey must meet a few conditions:
- All flights must be under one booking, not purchased individually
- Your disruption must be eligible under EC 261, including being caused by the airline and not factors such as a strike or bad weather conditions.
The amount of compensation depends on the distance, the disrupted flight and any legs that come after it. Any legs of the journey that came before the disruption might be included as well if they were operated by the same carrier responsible for the delay, and if there were no intervening flights operated by a different carrier.
If you are stranded for an extended period of time at the airport and you do not accept any offer that waives your right to compensation, such as accepting a bonus-points voucher, you can file a claim. Keep all receipts for any expenses incurred as a result of the delay. You will have to document your flight with at least the confirmation code and your ticket number, both of which you should have in an e-mail if you lost the boarding pass.
EC 261 exempts compensation for “extraordinary circumstances” such as bad weather, security threats, airport strikes and air-traffic-control decisions.
On top of EC 261 compensation, the carrier also must provide you with meals and refreshments during the delay, and access to communications, including telephone calls, fax messages, and emails. If you are forced to stay overnight due to the delay, the carrier should pay for your hotel, and transport to and from the airport.
Contact the airline that delayed you by asking for EC 261 and send in copies of your receipts and flight documents. If your request goes unanswered, consider contacting AirHelp, or other third party intervention services.
If AirHelp or other third party intervention services must take the airline to court, you’ll also have to sign a power-of-attorney. AirHelp cites a 98 percent success rate in court.
All third party intervention services charge 25 percent of a paid claim for their services.
